Terms and Conditions in Detail

These terms and conditions shall apply to all orders placed or to be placed at BHAVYA ART for the sale and supply of any products. By placing an order with BHAVYA ART, you represent that you are at least 18 years old (or that you have your parents’ permission to purchase from us). These terms and conditions have no bearing on your statutory rights. Other terms or modifications to the terms & conditions cannot be agreed upon unless they
are in writing and are signed by us.

Terms and Conditions of Products

• All our products are Tanjore art on fabric or Tanjore artboards or Idols.
• Handle Fabrics with care: Use dry cleaning only as other wash techniques would compromise the paint print on the fabric.
• Prior to opening the package kindly inspect the product for any damages and reach out to us if any at our official email address: mailtobhavya@gmail.com
• We are not responsible for any damage to the fabric or articles post-delivery. Retouch services are not available; however, products can be ordered again.
• You are responsible for resolving any problems brought on by the delivery partner (All purchases made from BHAVYA ART are made in accordance with a shipment contract. This indicates that upon our delivery of such things to the carrier, the risk of loss and title thereof passes to you.

Personal Information

BHAVYA ART, who is designated as the data controller, shall manage any personal information you give us or that we acquire. Your personal information will be used to assure delivery to you, to determine your creditworthiness, and to send you offers and information about our product. Your information won’t be disclosed to any other parties and will only be accessible to BHAVYA ART. You concur with the foregoing by accepting the BHAVYA ART User Terms.

Payment

Until full payment is received, all products are BHAVYA ART property. The price that applies is the one that was set at the time you place your order. Prior to confirming the order, the price of the products and shipping fees are provided. If you are under 18, you must obtain your parent’s consent before making a purchase from BHAVYA ART.

To ensure your protection, all transfers made through BHAVYA ART are managed and completed through specialized third-party channels. No card/payment information is saved, and SSL encryption is used to process all card information. Even as the chosen payment gateway is solely accountable for the transactions made, please read their terms and conditions.

Force Majeure

Events outside of BHAVYA ART that are not reasonably foreseeable are considered to be acts of force majeure, which exempts BHAVYA ART from its contractual obligations. Examples of such occurrences include government action or inaction, new or amended legislation, a dispute, an embargo, a fire or flood, a sabotage attempt, an accident, a war, a natural disaster, a strike, or a supplier’s failure to deliver. Policies of government like limits, warnings, bans, etc. that have a detrimental impact on the market and products are also considered a force majeure.

Additional Information

BHAVYA ART reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase, and product offerings without prior notice. In the event of when a product is sold out, BHAVYA ART has the right to cancel the order and refund any amount paid in the best way. BHAVYA ART shall also notify the customer of equivalent replacement products if available.

Products and Services

All product descriptions and prices are subject to change at any moment and without prior notice at BHAVYA ART sole discretion. Anytime, we reserve the right to stop selling any product. Any offer made on this website for any product or service is void where prohibited.

Return Policy

Within three days of your purchase, you are eligible for a refund or exchange. Please note that the product must be returned unused, in original packaging. In case of a refund, neither the original shipping cost nor the return shipping cost will be reimbursed.

In line with Indian law, these User Terms and any other agreements under which we supply you Services will be interpreted. The courts in Bengaluru City, Karnataka shall have exclusive jurisdiction over any proceedings arising therefrom.

Any disagreement or dispute between the parties hereto regarding the interpretation or otherwise of the User Terms and other Site policies shall be submitted to an impartial arbitrator who will be chosen at random, and whose decision shall be final and binding upon the parties hereto. The Arbitration and Conciliation Act, 1996, as amended from time to time, shall apply to the fore mentioned arbitration. Bengaluru City in the state of Karnataka will serve as the arbitration’s seat and location.
